黄河西塬畔的东雷村至今还保留着一种古老的民俗，即上锣鼓。它是一种粗犷豪放、情绪热烈、舞蹈性极强的民间艺术，带有浓郁的祭祀色彩和拙朴的地方特色。从表演特色到古典以及使用的鼓钹都与周围村庄相异，更与外地不同。
说到东雷的上锣鼓，不能不说东雷村的民间艺人马笃学。马笃学，1948年生于坊镇东雷村。1961年，年仅13岁的他接受其父传承，开始学习上锣鼓的敲击艺术。此后，逐步掌握、不断创新，使上锣鼓表演臻于完善，成为合阳远近闻名的第一鼓手。这是一位憨厚朴实的黄土人，自小就看到先辈位每逢正月摆社火，敲锣鼓，而且这种古老的民俗伴随他成长。幼时，他看到表演就主动模仿，甚至在老艺人休息之机，他也能随意敲打几下。13岁那年，父亲把他叫到跟前，说：“男子十二脱父子，你已经十三了，应该将上锣鼓这门手艺传下去”，由此，父亲就经常会让他参加上锣鼓的表演，并教给他敲打的方法。到了十五六岁时，他便主动参加村里举办的社火，跑龙套、干杂活。凭借着他的热情和执着，虚心学习，细心揣摩，终于成为社火中的主力。
东雷村的上锣鼓的具体表演时间都在农历正月十四到十六日，有时候热闹了，正月十七再上。这就是当地人说的过“十五”闹元宵节。这个时期，元宵节刚过完，农活还没开，村里人就借机在一起热闹几天。
记得他刚当上村长的那一年正月，村里的老艺人们坐在一起闲聊时，又说起了上锣鼓，说“今年能搞一次社火，敲一下锣鼓，那该多好呀！”但还有一些人说：“这几年，人们都抓经济了，看谁家挣的钱多，还有多少人热搞这个”。说者无意，听者有心，马笃学立即把村干部叫到村委会商议耍社火事宜。他说，“今年是我们这个村委会班子刚成立的一年，要想让大伙过个好年，就必须丰富村里的文化生活”，“我看咱们今年还是以社火为主，组织村民热闹热闹。”其他村干部都表示同意。当晚就拟定方案，把原有的老艺人组织到一起，又把村里留守的年轻人组织起来，由老艺人表演，年轻人学习。经过年前半个多月的培训，上锣鼓表演告一段落。
农历正月十四日，大约三点钟，村里的男男女女，老老少少都向村委会涌去，村里的锣鼓手早已开始敲敲打打，酝酿气氛。天色将晚，看热闹的群众越聚越多，艺人们的表演兴致愈高。只听得村支书马笃学宣布：“东雷村上锣鼓表演现在开始”。所有的艺人们一齐表演，顿时鼓声、锣声、铙钹声齐响，如草原上千军万马奔腾。艺人们在紧锣密鼓的一阵表演后，又分为老年组和青年组，在村中央的大场上摆开阵势，进行对阵，定要争个高低。马笃学加入到青年组，村长加入到老年组，与所有参加表演的人一样，赤裸着上身，斜挎一串马铃，下身只穿一条短裤。显示出渭北农民的阳刚之美。寒冬腊月，却没有人感到寒冷。相反的一个个汗流浃背。敲大鼓的还要有个人在背后用簸箕扇凉哩。每组里都有几个技艺精湛的人穿着奇异，或者用核桃皮挖个洞做成眼镜、或者用破草帽戴在头上、再插一根红萝卜、红萝卜上再插几根鸡毛等等。
这次表演，马笃学充分发挥了年轻人的优势，从衣着上大胆创新，增加了现代气息。而老年组以继承了先前的衣着，体现出古朴特色。从表演的形式上，老年组发挥传统优势，以先辈们的传统方式表演，青年组以马笃学为中心，大胆改革，从表演的动作、古典的节拍、鼓手、锣手的配合上进行了创新。
上锣鼓开始时敲的古典叫“排锣”，节奏较缓，十分整齐，是在酝酿情绪，同时向看热闹的人宣告：马上就要开始上锣鼓了，当然还有呼叫那些尚未到场的同伴的意思；接下来的鼓点称为“流水”，比“排锣”节奏加快，花样也多，向对方挑战的意思十分明显，显示鼓手的敲打水平，也在这一部分；在接下来进入“上鼓”阶段，此时敲打的人情绪发展到高峰，鼓手骑马蹲裆，敲锣的一脚踏鼓，一脚踩地，锣棰经头部画弧，先击鼓，后击锣，鼓手则高举鼓棰和锣手调开击鼓，否则就要砸烂手的。鼓手和锣手边敲边围鼓转圈，十分整齐；敲铙的则把铙高高举过头顶，矫健有力。这时古典节奏急促，气氛热烈，有如爆豆一般。看热闹的群众受了感染，也随着锣鼓的节奏“噢——噢——”地齐喊。敲的人听到喊声得到鼓舞，更加起劲。气氛酝酿成熟了，领头的人使个手势，鼓点变成“乱刮风”，锣、鼓、钹齐响，没有明显的节奏，有如风吹梢林，松涛怒吼，又似大海涨潮，浊浪排空。只听领头人“吁——”地一声悠长尖利的口哨，早已做好准备的一个五大三粗的小伙子猛地蹲下身，双手抓住大鼓上的铁环，抡上脊背，撒腿便跑，其他人在后紧随；另一家见状，同样扛鼓便跑。两家在广场上拼命追逐，都想把自己的鼓摞在对方鼓上，对方哪里肯让，你争我夺，难解难分。据说，上锣鼓的“上”就是由此得来的。这个时候，添上一轮明月高照，地上无数盏灯笼争辉，芦苇扎成的火把高高举起，干柴笼起的火堆熊熊燃烧；火铳震天，硝烟弥漫，口哨声此起彼伏，动人心魄；马玲哗哗，喊声阵阵，你要在我的锣上敲一下，我想在你的鼓上擂一下，鼓棰飞舞，锣棰乱抡，使人如入“铁骑突出刀枪鸣”的战阵之中。如此反复几次，等到夜深，大家又整整齐齐地敲打一阵，收兵回营，带着无限的满足安然入睡。如果当年不摆社火，上锣鼓的地点便由广场移到巷道里。人群在巷道里追逐，似两条“火龙”在村子里游动，连环河对岸山西的人也能看的清清楚楚。
东雷村的上锣鼓，在马笃学的组织下，每年都要表演多次，不仅仅在村子里表演，还到县城表演。80年代中央电视台专题采访，制作成专题片，07年参加渭南大型社火锣史《华山魂》的表演，誉满陕西；08年参加了中国洽川国际诗经研讨会民间表演获得专家的好评；2000年东雷上锣鼓获得合阳县锣鼓大赛一等奖。县文化局将这种民间艺术作为非物质文化遗产申报到省上，马笃学也都评为上锣鼓的传承人。县上只要有大型群众文艺活动，必然有东雷的上锣鼓表演。&&&&
作为上锣鼓的继承人，在表演的同时，他还重视研究工作，指导培养新人，开展传承活动。现在马笃学的家里，可以说是上锣鼓大学堂，既有研究，整理，上锣鼓打击，表演的详尽资料，又整理出了一套很有价值的鼓点鼓谱，同时还保存了历次活动的经历史料和照片资料。村里的艺人们经常到他家里学习、研究、探讨。为了使上锣鼓更具魅力，他在继承父辈演艺的基础上，不断探索，改进表演形式，提高表演的艺术效果，他将其表演过程，分为四个部分，一是开场锣鼓（引导），平稳延缓，具有找来观众，酝酿气氛的作用；第二部分背鼓跑鼓，形成对峙，相待不下，拉开敲击的场面；第三部分流水锣鼓，大鼓配以小鼓，在敲击中仿佛一问一答，阴阳顿挫，振节有序，十分好听；第四部分为上鼓，上锣鼓表演出现高潮，锣手赤身轮番上鼓，锣鼓铿锵有力，气势磅礴、热烈、粗犷，展示出黄土地男子汉的气魄。上锣鼓主要特点是阵容庞大，气氛热烈，气势恢弘，敲击震撼，具有原始的阳刚之美。
把上锣鼓搬上舞台，组建专业表演队，是马笃学的梦想。为了实现这一梦想，马笃学多次与文化主管部门进行协调；利用农闲时间，在村里举办培训班，义务为群众传授上锣鼓的基本知识，聘请老艺人为技术顾问，鼓动群众每家每户购置鼓、锣、铙钹等乐器；据初统计，参训村民达200多人∕次，同时鼓动儿子马晓全马晓亮组织年轻后生，一个30多人的专业表演队伍产生，从事各类庆典、开业、会议等礼仪表演活动，每年春节期间在村上义务表演，活跃村民的文化生活。通过这一形式上锣鼓常演不衰。
东雷上锣鼓早产生于先民的祭祀、驱邪活动，随着民间艺人的不断吸收，打磨才形成了今天独具一格的表演风格，马笃学在改革创新中，为适应演出的需要，又对东雷上锣鼓进行了加工，使这一民间艺术瑰宝既可进行广场表演，又可进行舞台表演，马笃学说的好，经过整理提高，他决心让东雷上锣鼓进向全国。

& 合阳，一个突飞猛进日新月异的县域，一片底蕴深厚文化厚重的沃土。踏着科学发展的强劲旋律，迈着争先进位的铿锵步伐，合阳正朝着西部果畜强县、煤炭工业重县、生态旅游名县、品牌教育大县、文明和谐新县的宏伟目标大步前进。合阳县司法局在县委、县政府和市司法局的坚强领导下，围绕“三项重点工作”和全县工作大局，突出目标责任管理，认真履行职能作用，抓班子、带队伍、强素质、树形象、促工作、保稳定，为创建平安合阳、促进县域经济社会发展做出了积极的贡献。&&&& 一、队伍建设篇&&& 合阳县司法局设有办公室、法制宣传股、基层工作股、社区矫正股、公证律师管理股、法律援助中心和考核股等7个股室，16个基层司法所，公证处以及3个律师事务所，负责县依法治县办公室、刑释解教安置帮教办公室、社区矫正办公室的日常工作，具有法制宣传、法律服务、法律援助、人民调解、社区矫正、安置帮教等工作职责，承担着全县普及法律知识、维护群众权益、促进司法公正、确保社会稳定的重要任务。连续多年被合阳县委、县政府和县政法委评为人民群众满意的政法单位，多次被省市有关部门评为创佳评差、创先争优工作先进单位。2002年被司法部授予全国人民调解工作先进集体，2008年被省司法厅授予“执法规范化示范单位”，2010年全省“两率一度”测评工作名列全市前茅，综合工作被市司法局评为目标责任考核优秀单位。&& 二、法制宣传篇&& 普法工作是司法行政工作的首要任务，负责组织指导全县的法制宣传普及、法律学习培训、法律知识考试和各项依法治理工作。每年县司法局都要制定全县普法依法治理工作要点，开展法律进机关、进乡村、进社区、进学校、进企业、进单位的法律“六进”活动，开展学法律、讲权利、讲义务，讲责任的“一学三讲”活动，开展民主法制示范村和法制校园活动，推动普法工作向全面和纵深发展，大力提高全社会的法律意识、法制观念和依法办事能力。&&& 针对近年来青少年违法犯罪比较严重的社会问题，县司法局牵头组织教育局、法院、公安局、关工委等单位共同开展“送法进百校”法制宣传警示教育活动，对全县100余所中小学校10多万学生进行了法制教育。在年度干部法律知识考试中，精心组织全县领导干部认真参加考试，并把考试结果报送组织人事部门作为干部考核依据，提高了公务人员的法律素质和依法办事能力。以12•4全国法制宣传日系列活动为契机，组织依法治县领导小组成员单位采取电视、板报、发放宣传单、法制文艺演出等形式，不断提高普法工作的影响力和覆盖面，引导人民群众自觉学法用法，积极用法律武器维护合法权益、创造平安美好的家园。&&& 三、基层工作篇&&& 基层司法所和人民调解组织是司法行政工作的前沿阵地。近年来，县司法局大力加强基层司法所的办公用房建设，争取国债资金96.5万元，为16个司法所新建、购置了办公用房，配发了警用摩托车、电脑、传真机、一体打印机、办公桌和调解台，为司法员配发了制式服装，理顺了司法所的管理体制，提升了司法所的规范化工作水平，司法所的住房、交通、办公条件得到显著改善。&&& 我们积极全面贯彻《中华人民共和国调解法》，认真搞好“八千举措抓化解、力促三秦大和谐”专项活动，全力推进社会管理创新“6+1”惠民工程，充分发挥人民调解的特色和优势，不断加强调解组织建设、队伍建设和制度建设，不断完善工作机制，广泛开展矛盾纠纷排查化解工作,不断提升了村（居)人民调解委员会的规范化建设标准。并积极协调交警大队等单位，组建了高标准的道路交通人民调解指导委员会和道路交通人民调解委员会。目前，全县共有调解组织376个，人民调解员1772人，基本形成了覆盖全县城乡的四级调解网络，完善了人民调解、行政调解、司法调解“三位一体”的矛盾纠纷联动调处机制，使我县人民调解工作走在了省市前列。我县甘井司法所所长、镇调委会主任雷崇新被授予“百名调解能手”称号，黑池司法所所长、镇调委会主任王荣喜被评为“全省十佳”人民调解员，两个司法所被评为省级规范化司法所，10个村级调委会被评为省级示范化调委会。近三年来，全县人民调解组织调处各类民间纠纷3466件，防止民转刑案件270件，杜绝各类越级上访案件74起，防止非正常死亡26人，消除了大量的不安定因素，为创建平安合阳作出了积极贡献。&& 四、社区矫正和安置帮教篇&&& 社区矫正是司法体制和工作机制改革中移交给司法行政系统的一项新的职能。在2010年试点的基础上，我县社区矫正工作今年全面铺开，共接收社区服刑人员80人。我们积极探索创新工作模式，不断提高矫正改造质量，最大限度地化消极因素为积极因素，总结提炼出了开展社区矫正工作应当把握的五个程序16个环节。为了强化对社区服刑人员的监管力度，我们协调电信局，开通了社区矫正人员“司法e通”，确保社区矫正人员随时在掌控之中，防止脱管失控。创造性地贯彻落实社区矫正有关政策规定，形成矫正教育、帮助扶持、监督管理一体化的矫正工作格局，促使社区服刑人员正确认识自己的犯罪行为和社区矫正工作，自觉做和谐社会的建设者。在社区矫正机构协调帮助下，同家庄旧堡村同某创办了利民奶站，坊镇赵家村的行某在腾远奶牛场当了饲养工，他们积极用自己的实际行动回报社会，感谢党和政府的关怀。&& 安置帮教是促进刑满释放人员尽快融入社会的重要工作。我们始终注重做好刑释解教人员的安置帮教工作，依据监狱、劳教所移送的安置通知书及相关资料，主动与公安派出所联系，深入村组社区，落实帮教措施，定期调查回访，掌握了解刑释解教人员的思想生活状况，解决他们的实际困难，我县刑释解教人员无一例重新违法犯罪，维护了社会的和谐和稳定。&&& 五、法律服务篇&&& 合阳现有注册律师事务所3家，注册律师15人，实习律师12人。全县律师凭着过硬的法律素养，坚定的政治立场，仗义直言的服务理念，为群众提供法律咨询、代理诉讼进行辩护，积极参与各类涉法涉诉信访工作，为相关单位和群众提供免费法律服务，引导群众依法信访、依法维权，五年来，担任法律顾问80处，代理各类案件960多起，有效化解了社会矛盾，减少了重访、缠访、闹访现象的发生。&&&& 2010年8月合阳县政府常务会议审议通过了县局关于建立健全法律顾问制度的意见，9月县政府专门召开会议聘任了两名法律顾问，并下发文件要求在全县政府机关和部门、学校、医院、企业普遍建立健全法律顾问制度，把法律顾问制度情况列入县政府目标责任考评范围，目前法律顾问工作已经遍及全县各个领域。今年我们还协调配合县人大、县政协为全县人大代表和政协委员配备了法律顾问，为代表委员参政议政提供了强有力的法律保障。&&& 公证处围绕县域经济社会发展，充分发挥服务、沟通、证明、监督四大公证职能，积极办理产权交易、证据保全、按揭贷款等各类公证事项，为企业、单位、家庭、提供了优质高效的法律服务，为县上的重大工程招标、项目引进、房地产开发等重大事项提供了坚实可靠的法律服务，10年来办理各类公证案件7858件，义务代书1350余份，调处公证纠纷82起，出据执行证10件，挽回直接经济损失44万元，为老弱病残，贫困家庭提供法律援助、减免公证费26万余元，在省市公证案件评查活动中，合阳县公证工作合格率连续多年达100%，得到了上级业务部门和社会各界的一致好评。&&& 六、法律援助篇&&& 法律援助工作一直是我县司法行政工作的亮点。多年来法律援助中心多方争取资金，积极为妇女、残疾人、农民工等弱势群体，提供高效便捷的法律援助。全县所有镇（办）都建立了法律援助工作站，90%的行政村设立了法律援助工作联络点，并在妇联、工会、残联、团委等单位设立了法律援助工作站，形成了覆盖城乡的法律援助工作站，为低收入群众和社会弱势群体代理法律事项3600多起，减免各种代理费、咨询费、车船费等服务费用46.5万元，挽回经济损失210万元，得到了受援群众和社会各界的好评，多次被省市有关部门评为法律援助工作先进集体，被市老龄委、市妇联授予“依法维权”先进集体，2010年度被陕西省司法厅授予“陕西省规范化法律援助机构”等称号，为社会稳定、平安创建写下了浓墨重彩的一笔。&&& 伴随着创先争优和主题实践教育活动的深入开展，乘着国家司法体制和工作体制改革的强劲东风，有着县委、县政府和市司法局的正确领导，有着全体司法行政干警的共同努力，相信合阳县的司法行政工作将会有一个长足的发展，必将迎来更加美好的明天。
